These terms and conditions govern the sale of products presented on the website www.foie-gras-ramajo.com, which is owned by SARL RAMAJO Foie Gras – lieu-dit Merlet - Dému Gers.

 

All orders imply acceptance of these terms and conditions of sale.

The sales contract is subject to French law.

 

-1- The offer

Our product offers are valid while stocks last, in mainland France, Corsica, and the overseas departments and territories.

The items sold are described and presented with the utmost accuracy. If, despite all our precautions, errors occur, we cannot be held liable under any circumstances. The photographs representing the products are for illustrative purposes only, as alterations may occur when they are transferred to the website.

We may be forced, due to our suppliers, to deliver an item that is slightly different from that described on the website, but in any case of equal or even superior quality to the item ordered.

 

-2- Prices

Our prices are quoted in euros and take into account the French VAT rate in force.

They are guaranteed subject to typographical or printing errors.

Any change in the French VAT rate will be immediately reflected in our prices.

Our prices do not include a flat-rate contribution to the costs of shipping and packaging the parcel(s) (according to the amount in force).

If you wish to order online, a guided search allows you to find all the products presented on our site and make your choice before placing your order.

 

-4- Acceptance of the offer and confirmation of the order For all orders placed on our website www.foie-gras-ramajo.com,

The contract is formed when the customer confirms the order.

 

 

-5- Payment

Payment for an online order with delivery is made in advance, without this advance payment being considered a deposit or down payment.

Payment is made by credit card after sending the card number, the last 3 digits of the security code, and the card's expiration date.

Payment is recorded from the date of invoicing of the package(s).

In the event of products being out of stock or unavailable, the debit will only be made for the amount of the products actually sent.

To ensure payment security, we use the PAYBOX secure payment service.

Your payment request is routed in real time to the secure remote payment manager, which carries out various checks to prevent abuse and fraud.

In all cases, the online provision of your card number and the final validation of your order will constitute, in accordance with the law of March 13, 2000 on electronic signatures, proof of the entirety of the order and the payability of the sums due in execution of said order.

-6- Delivery

Orders are delivered by our various carriers in mainland France, Corsica, and the French overseas departments and territories, with a flat-rate contribution to the shipping and packaging costs of the parcel(s) according to the amounts in force. For shipments of fresh and semi-preserved products, the delivery time is 24 hours from the time the package is deposited by our carrier at the customer's address or at the pick-up point. It is the customer's responsibility to store and preserve the products (at a temperature between 0 and +4°C). We do not guarantee the storage temperature of the products if the customer does not collect the goods on the day of delivery.

The average delivery time (excluding fresh products) in mainland France and Corsica is 3 to 10 business days, and 10 to 15 business days to French overseas departments and territories.

These delivery times are for business days, excluding postal delivery problems and depending on product availability.

In the event of delivery disputes (broken products, damaged packaging), the customer must note this on the carrier's delivery note and inform us within 24 hours so that we can contact the carrier.

In accordance with the provisions of the Consumer Code, delivery will take place no later than thirty days after the order has been confirmed. Failing this, the consumer may automatically request the cancellation of their order by registered letter with acknowledgment of receipt and obtain a refund by any means of payment, or, if they wish, a credit note.

 

-7- Withdrawal period

Unless you want the products ordered to be delivered before the expiry of a period of fourteen clear days, or the products ordered are likely to deteriorate or expire rapidly, you have a period of fourteen clear days to exercise your right of withdrawal without having to justify your reasons or pay any penalties, except for the cost of returning the package(s). This fourteen-day period starts from the date of receipt of the product ordered.

When the withdrawal period expires on a Saturday, Sunday, or public holiday, it is extended to the next working day.

The withdrawal clause cannot be exercised on fresh products or products that are likely to deteriorate or expire quickly.

-8- Refund period

When the right of withdrawal is exercised, we will refund the amount of your order, minus the cost of returning the package(s), within fourteen days of the exercise of the right of withdrawal.

 

-9- Personal data

The collection of your personal data is necessary to process your request. By providing us with your email address, you will be able to receive confirmation of your order. Your data is processed in accordance with the recommendations of the GDPR and you have the right to rectify and delete your data at any time. 

 

-10- Intellectual property

All elements of the www.foie-gras-ramajo.com website, whether visual or audio, including the underlying technology, are protected by copyright, trademark, and patent law. Users who have a personal website may place a simple link on their site that directs users to the homepage of the www.foie-gras-ramajo.com. website. This does not constitute an implicit affiliation agreement. However, any hypertext link to the www.foie-gras-ramajo.com website using framing or in-line linking techniques is strictly prohibited. In any case, any link, even if tacitly authorized, must be removed upon request by SARL RAMAJO Foie Gras.

SARL RAMAJO Foie Gras cannot be held liable for any inconvenience, damage, or harm of any kind relating to the use of the Internet, such as a break in service, the presence of computer viruses or external intrusions, or more generally any cases qualified as force majeure by the courts.

As such, SARL RAMAJO Foie Gras cannot be held liable in the event that, due to the failure of its own suppliers and for reasons unrelated to the existing relationships and agreements between these parties, it finds itself suddenly unable to offer the products presented on its website for sale.
